1. Introduction

Welcome to GuardBlock. We aim to make this Policy easy to understand, so you are informed of how we use your information. You must agree to our Privacy Policy to use our Site or Service. 2. Personally Identifying Information You Explicitly Provide


2.1. What You Provide

You are not required to submit any information when visiting our site. To open an account on our Site or Service you have to provide an email address to create your account. We will use this email address to notify you about your account, and to contact you regarding our services you engage with. You will use this email to login and access our services.

We may required/authorised by the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 to verify your identity before we can provide you with certain aspects of our service, if AUSTRAC (the Australian financial services regulator) determines them as being Virtual Asset Safekeeping Services and subject to the Act and Rules. These new rules and their applicability to our services are still being clarified and confirmed by AUSTRAC.

To be clear: at the time of the latest published date of this policy, we do not need to collect identifying information before allowing you access to our services, but this may change in the future. This policy will be updated accordingly as we receive information from the regulator, AUSTRAC.

If we receive a regulatory enforcement decision that specifies that this service falls under the rules of the act and the regulator, then you will need to provide sufficient documents to verify your identity before accessing certain parts of our service or before we can take certain actions on your behalf, such as making a transfer of Bitcoin using a recovery key, or allowing access to funds via an inheritance protocol.

Forms of ID used to verify you can be, but are not limited to, Passport, Drivers License, Medicare Card, Citizenship certificate or VISA. In some cases, we may require 2 forms of ID.

We make use of an authorised provider of the Attorney-General’s Department’s Document Verification Service (DVS) system in Australia to verify Australian IDs for legitimacy. As a part of this ID verification and in order to deliver our Services to you, you may be asked to add data to your account, such as your name, address, DOB and phone number.

If you choose to engage in our Inheritance Protocol service, then you will need to disclose information that allows us to conduct inheritance procedures in the event of your death. This may be: details and ID information of the Executor of your Estate, your heirs, and your specific instructions regarding your inheritance for assets held in a vault with us.

We may legally obligated by our Australian financial regulators to collect this information before providing you with these services.

Declining to provide this information may result in an inability to take certain actions regarding your account with GuardBlock. However, due to the way we have set up our service, an exit pathway is available to remove your bitcoin from your vaults if we are made to collect this information from you, and you do not wish to provide it. We will notify you accordingly so you can make an informed decision whether to continue accessing our services, or not.

We are bound by the provisions of the Privacy Act 1988 (Cth) (Privacy Act), including the Australian Privacy Principles (APPs), as well as the Identity Verification Services Act 2023 (Cth) (IVS Act). Your personal information will be handled in accordance with our obligations under this Act.

If collected, this information will be retained for as long as it is needed for the purposes outlined above, which is typically 7 years from your last transaction with us.

2.2. What We Do With This Information

We do not and will not sell or transfer your personally identifying information to third parties without your consent. However as a condition of using this service you agree that we may:

  • Verify the integrity of your documents and your identity by the use of government agencies and authorised third party document checking service providers,
  • In the event of suspected fraud, or when required by Australian law, we will provide your identity information to Australian regulatory or law enforcement agencies,
  • Your email address will be disclosed to our email service provider(s) for the purpose of us communicating with you,
  • Details of your Executor of your Estate and your heirs may be used in the event an Inheritance Protocol is initiated. This may include disclosure to specific third parties relevant to such proceedings, such as lawyers, to ensure the correct procedure is followed.

3. Non-Identifying Information Collected


3.1. What We Collect

When you visit our site we may collect non-identifying information from you. This can be your; IP address, location, referring URL, browser, operating system, interactions with the Site and Service, cookie information, usage, data transferred and Internet Service Provider. Without additional information from third parties this information will usually not be enough to identify you.


3.2. What We Do With This Information

We don't and will not sell or transfer your information to third parties without your consent. However as a condition of using this service you agree that we may use your information for:

  • Enhancing or improving our users experiences,
  • Processing transactions,
  • To share with our partners to track affiliate commissions, process, transactions and otherwise enhance or improve our users experiences,

We may have links to Third Parties on our Site/Service/Emails. We do not control or review their Privacy Policy or issues. We are not liable for the conduct of such third parties. Some of these Third Parties may be international entities with services located overseas.

This Privacy Policy as well as any other Policies only refer to the GuardBlock Site and Service. We hold no responsibility for any information acquired by any Third Party site/Advertiser/Service or other entity.


10. Accessing Your Personal Information

You have a right to access your personal information, subject to exceptions allowed by law. We will require appropriate security precautions and reserve the right to charge a fee for searching and providing access to your information.
